Schapelle Corby
Murph, at Special Sauce, has a good summary of the prosecution and defence cases, and his conclusion sums up Corby’s defence, Corby: Pt 892. Kev, while he was not altogether firm on it,plumped last week Corby is guilty. I had argued the baggage scandal might have sown reasonable doubt but, observed, the Indonesian courts seem to run on, defendants in criminal cases have a burden of proof. Reasonable doubt, but, the Oz Govts’. letter to Corby’s lawyer is worth nothing at all as far as what is required , evidence , remarking that the jubilation of lawyers ove that latter was, frankly, silly.
Last weekend, a newspaper splashed photos of some of Corby’s family. Her father wastes his days smoking pot, someone else had spent time in an hotel for crims. The family has form, a lot of lbs of it in the green leaf form.
4ks, a tad over 8lbs of marijuana, not exactly a personal use quantity. The trial judge has , in an interview, many who have been caught trafficking have done the smae in court, cried, proclaimed their innocence and so forht. Understandable, but not a guide , as the judge observed, as to innnocence or guilt.
The underlying coonsideration, it is no secret, the Indons keenly hunt drug traffickers and slap down harsh penalites, and yet, some Aussies still persist in attmepting to do so, and delude themselves they can get away with it. They clearly do not take in one tittle of the long list of reports of smugglers caught and banged into an Indon hotel either on death row or for a life sentence and, by life sentence that is what is dealt out.
The death penalty for traffickers is odious, and 30 years rather more than a tad odious too, and both out of proportion to the sentences hanbed out to Muslim mass murderers. As vicious as all that is, nonethless that is the position of the Indons. Dumb Aussie youfs, no they are not, they took their chances despite the fact that is the siutation in INdonesian and, they were caught. All those, including the medja, screaming how terrible the Indons are, conveniently overlook, the stupid would not be facing a life sentence or death penalty if, she had not been a pothead in the first instance and went on to try her luck as a trafficker via Indonesia.
Kev has commented on a letter in which a writer seems rather confused, Kev, being the gentleman he is, doens’t say the writer is off the planet:
{a} The real issue is not whether Schapelle Corby did it or not, but {b} whether the sentence will be life imprisonment or death.
If {a} is not germane to anything much at all to anything Corby has done, then the Judges would not be contemplating {b}. That writer must have lobotomised himslef with his pen, he stuck it up his nostril and punctured the few ounces of grey matter he is in possession of.
{a}Both the media and the politicians have misread the Australian public on this issue. {b}There is anger out there that a Muslim cleric is getting a few short years for arranging a bombing that killed many Australians, {C}yet this young woman faces a life sentence or death. That?s the issue!
{a} Funny that one, the medja have been beating the Corby fan club drum loudly, everyday. The pollies have too, and, funny that, Howard and Downer wrtoe that letter in order to avert what Corby is facing.
{b} and {c} are not linked. Yes, of course some are utraged on the count of {b}, but not necessarily angry over {C}, some may be, both Murph and Kev having fulminated against both possible sentences, and one is revulsed at both too. Yet, that is the position of the Indons, and, the Govt. cannot, for blindingly obvious reasons, do anything but, for example, send a strongly worded letter on the count of both of them, which it has in the case of {B}, and has intervened , by the latter in view of {c}.
No matter how many fulminate, including yours truly, we are yet brought back to the hard stubborn fact, the Indons take a very dim view of drug trafficekrs, and, when they catch them, dish out very stiff sentences. Dersptie that being the positon, Corby decided she would make theattmept, beleiving,, no doubt , she was cleverer than the Indon police and customs inspectors and, get away woith the crime. Well she didn’t, they risk she took has been realsied, she faces a long stay in an Indon hotel or, an early death. That is what the case boils down too.
Other Aussies contemplating what sommany have already failed to do, might ponder the fate of Corby, but the gang of nine also. It is false sentiment to cry when, traffickers, inlcuding Corby, are fully apprised before attempts of the hard stubborn facts of the Indon position on traffickers and trafficking is. As horrific as the sentences are, that sentiment is quenched somewhat by reminding oneself, she went there, she did it, despite the fact she was nbot ignorant of the risks. She took her chance, good, she was caught, now she must face the consequences and that is all there is too it. Let Corby and so many otrhers be a waringing to pothead assholes contemplating a `selling’ trip to not only Inodn, but Malaysia, Thailand, China, and oh, a rather longish list of Asiatic countries.
There are those for whom compassion ,and a willingness to fight for them, is well warranted, Corby is not one of them.

I personally know someone who was the victim of an attempted drug setup in Indonesia, so I think I’ll reserve my opinion on her innocence. I do think that her defence team let her down in several areas.
However, there are some gaping holes in this case - no fingerprints taken, everyone (even the media) allowed to handle the bag, no tests to determine where it was grown, no record of interview, discrepencies between the customs officer’s and Corby’s version of events, no translator provided… I wouldnt like to be tried under these circumstances.
The Indos may officially take a dim view of drug trafficking, but Indonesian officials are not above corruption, and since Indonesia regularly comes in the first ten of most corrupt countries in the world, I think Australians are right to have some concerns about this case.
Indonesian officials and the military were heavily involved in people smuggling, making plenty of money from ‘asylum seekers’. I cant believe that the same people would recoil at making money from drugs.
